% 17.01.2018 The counsel for the petitioner after arguing for some time submitted that he may be allowed to withdraw the present petition and the application filed therewith though he seeks a clarification that the observations made by the trial judge in the impugned order on the merits of the legal objections to the maintainability may not be treated as final expression on merits.

The observations, it is clear, were recorded for purposes of disposal of the application under Order XIV Rule 5 of the Code of Civil Procedure, 1908 and, therefore, cannot be treated as final or binding.

With this clarification, the petition and the application filed therewith are dismissed as withdrawn.
