% 18.09.2017 I.A.10749/2017 This application is filed for the release of an amount of Rs.10 crores in favour of the applicant deposited by the Registry. Pursuant to order dated 14.12.2016 and 02.02.2016, the respondent had deposited a sum of Rs.24,15,15,530/-. Part of the amount has already been withdrawn by the petitioner on furnishing of appropriate bank guarantee. The petitioner is permitted to withdraw the balance amount on furnishing an appropriate bank guarantee to the satisfaction of the concerned Joint Registrar. This application and petition is disposed of.

It is clarified that the petitioner would be at liberty to request for withdrawal of bank guarantee in case of dismissal of the appeal under Section 37 of the Act.

List before the Joint Registrar for verification of the bank guarantee to be furnished by the petitioner on 22.09.2017.
