% 22.12.2016 Property disputes between the complainant (respondent no.2) and accused (petitioner) had led to registration of present FIR 141/13 under Sections 420 IPC at police station Barakhamba Road. Matter has been compromised between the petitioners and respondent no.2 vide Deed of Settlement dated 12th November, 2016. Learned counsel for the petitioner submits that sale deed will be executed in favour of respondent no.2 in respect of property situated at Naya Gaon, Tehsil Sohna, District Gurgaon, Haryana as detailed in the Deed of Settlement. It is further submitted a flat in Havana Heights, Sonepat, Haryana has also been allotted to the respondent no. 2, possession whereof will be given within three months.

Respondent no.2 is present in Court and submits that he has no objection in case the FIR is quashed, subject to petitioner fulfilling terms of the Deed of Settlement dated 12th November, 2016. In view of the above, FIR 141/2013 under Section 420 IPC registered at police station Barakhamba Road and the consequent proceedings emanating therefrom are quashed subject to, however, petitioner executing sale deed in respect of Naya Gaon property and handing over the possession of Havana Heights to the respondent no. 2 within three months.
