CORAM:
HON'BLE MR. JUSTICE VIPIN SANGHI
O R D E R
% 14.03.2017 The petitioner has preferred the present writ petition to seek parole for a period of two months to be able to prefer a Special Leave Petition. The petitioner is desirous of filing a Special Leave Petition against the judgment of this court dismissing his Crl A No.827/2014, which was dismissed on 01.09.2014. The petitioner is serving a life sentence for his conviction under Section 302 IPC in case FIR 95/2012. The status report tendered in court is taken on record. The earlier order passed on 11.09.2015 in W.P. (Crl.) No. 1092/2015 dismissing the petitioner's writ petition seeking parole has also been perused.
It appears that the petitioner has no means and is not in a position to furnish local surety. The petitioner's permanent address is of Bihar and the status report shows that he was arrested from the Nepal border. Thus, it appears that the petitioner is a high flight risk criminal. Learned counsel for the petitioner submits that in the alternative, he may be granted access to legal aid so that he could prefer a Special Leave Petition. In any event, the petitioner is not in a position to bear the legal expenses and he would be entitled to legal aid. The petition is, accordingly, disposed of with a direction to the Jail Superintendant to put the petitioner in contact with the counsels from legal aid who visit the jail so that he may be able to prefer a Special Leave Petition. The same be done within the next one week.
The petition stands disposed of in the aforesaid terms. A copy of this order be communicated to the Jail Superintendant. VIPIN SANGHI, J MARCH 14, 2017 sr
