O R D E R

% 08.12.2016 Present contempt petition has been filed alleging wilful disobedience of the order dated 27th October, 2016 passed in W.P.(C) 10284/2016 wherein respondent stated that Deputy Commissioner will dispose of petitioner's appeal against Revenue Assistant's order dated 18th August, 2016 on 22nd November, 2016. The Court directed that till then no coercive steps will be taken against the petitioner.

Learned counsel for petitioner states that despite the aforesaid order, the appeal was not heard on 22nd November, 2016 and proceedings were adjourned to 22nd December, 2016. He further states that despite the appeal still pending adjudication, respondent-Tehsildar is implementing the Revenue Assistant's order dated 18th August, 2016. Issue notice.

Mr. Sachin Nahar, learned counsel, on instruction of respondent, who is personally present in Court, states that the order dated 28th November, 2016 passed by him shall not be implemented till the appeal is disposed of by the Deputy Commissioner.

In view of the aforesaid statement/undertaking, learned counsel for petitioner does not wish to press the present contempt petition any further. Consequently, the statements/undertakings given by both the learned counsel are accepted by this Court and parties are held bound by the same. In view thereof, present contempt petition and application are disposed of.
