After hearing arguments for some time, learned Senior Counsel for petitioner, on instructions, states that in terms of the impugned order dated 17.09.2016, the petitioner/plaintiff would file appropriate fresh amended plaint before the learned Trial Court.

In view of the above said statement, nothing survives in the present petition.

Once any such amended plaint is filed in terms of the said directions, it will be for the learned Trial Court to take further appropriate action in accordance with law.

Waquas, learned counsel for respondent No. 3 stated that on the last date, though they had appeared their presence is not shown in the appearance. It is clarified that Mr. Sanjeev Sindhwani, learned Senior Counsel and Mr. Mohd. Waquas, learned counsel for respondent No. 2 had appeared on the last date of hearing and this order be also uploaded as corrigendum to the last order dated 04.09.2024.
