O R D E R
% 23.01.2017 CM No.2394/2017 (delay of 22 days in re-filing the appeal) In the facts and circumstances explained in the application, delay of 22 days in re-filing the appeal is condoned.
CM stands disposed of.
LPA No.47/2017 & CM No.2393/2017 (stay) 1.
Heard both parties.
2.
By the order under appeal dated 03.11.2016, certain directions were issued by the learned Single Judge on an application filed by the workmen/respondents in the writ petition for payment of wages under Section 17-B of the Industrial Disputes Act, 1947. LPA No.47/2017
3.
Though the appellant/writ petitioner sought to assail the said order on various grounds, having regard to the fact that the writ petition is of the year 2004 and the present appeal arises out of an application filed by the respondents for interim relief, we consider it appropriate to direct the disposal of the main writ petition itself expeditiously. 4.
Accordingly, we direct that the writ petition (W.P.(C) No.5830/2004) be listed before the concerned Roster Bench on 30.01.2017 for directions. We request the learned Single Judge to fix a specific date for hearing of the writ petition and dispose of the same as expeditiously as possible, preferably within eight weeks from today.
5.
Till such time the order under appeal be kept in abeyance. However, this Court shall not be understood to have expressed any opinion on merits of the case and the writ petition may be decided in accordance with law after hearing both the parties.
6.
The appeal is accordingly disposed of.
