The present Petition seeks the following prayers: "(i) Issuing a direction in the nature of a writ of mandamus, or other appropriate writ, to the Respondent for acting upon the renewal application, dated 24.08.2016, of the Petitioner and thereby duly renewing his licence; and (ii) Directing the Respondent for compensating the Petitioner appropriately toward loss of his earning in view of the expiration of his licence and the consequent failure of Respondent to renew the same; and (iii) Any other and further order (s) as this Hon'ble Court deems fit and proper may as well be passed."

It is the contention of the learned counsel for the Respondent that the present petition has become infructuous since a licence bearing no. 13969/2016-2019 dated 28.11.2016 has been issued to the Petitioner herein.

Learned counsel for the Petitioner submits that the said licence is illegal.

Reference is made to the Order dated 11.02.2025 wherein the Petitioner was directed to file an affidavit setting out as to whether the lis in the present Petition survives.

In compliance of the said Order, the Petitioner filed an affidavit dated 08.04.2025 whereby it is adverted as to how the reissued licence is illegal.

It is admitted fact by the Petitioner that the issues being contested now by the Petitioner are neither raised in the body of the present petition nor in the prayers sought.

Since the Petitioner has failed to raise a substantive challenge to the fresh licence dated 28.11.2016 issued to him, he cannot be permitted to raise the same orally without even making any specific prayer in respect of the same.

In view of the aforementioned, the petition along with the pending application stands dismissed.

No order as to costs.
