1. Mr Manoj Kumar, Assistant Commissioner is present in the Court. He states that the refund for the 4th quarter of 2008-09 is still pending. He points out that in terms of the order dated 24th May, 2017, the Petitioner had to furnish the requisite documents within ten days from that date. He states that the said order has not been complied with by the Petitioner.

2. A last opportunity is granted to the Petitioner for furnish the requisite documents as sought by the VATO not later than two weeks from today.

3. Subject to compliance of the above directions, the requisite refund order for W.P.(C) 12052/2016

the 4th quarter of 2008-09 shall be issued by the Respondent in favour of the Petitioner within four weeks from today. The refund amount together with the interest due thereon shall be deposited directly into the account of the Petitioner not later than two weeks thereafter.

4. In case of any non-compliance with the above directions, it will be open to the parties to seek appropriate remedies in accordance with law.

5. The petition is disposed of accordingly.
