O R D E R

% 15.03.2017 Learned Senior counsel for petitioner submits that petitioner was not present at the spot, at the time of shootout. The allegations of shooting the victim are against the co-accused. The allegation against the petitioner is that he had provided pistol to the co-accused Manish. It is submitted that petitioner was at his residence and was not present with the co-accused at the time of shooting incident.

No recovery has been affected from the petitioner. Petitioner is in custody since 27th May, 2016. Learned Additional Public Prosecutor has contended that role of petitioner is that of providing pistol to the co-accused. This fact emerges

from the disclosure statements of the co-accused persons. It is further submitted that Section 120B read with Section 302 IPC has been invoked against the petitioner. Trial is under way.

Keeping in mind the totality of the facts and circumstances, more particularly the role assigned to him, petitioner is admitted to bail subject to his furnishing a personal bond in the sum of `25,000/- (Rupees Twenty Five Thousand Only) with one surety of the like amount to the satisfaction of trial court.

Application is disposed of in the above terms. Dasti.
