This is a petition filed by the Petitioner under Article 226/227 of the Constitution of India read with Section 482 CrPC seeking quashing of case FIR No.296/2016 under Sections 376-B/307/342/328 IPC registered at PS Maurya Enclave.

Attention of learned counsel for the Petitioner was drawn to para 57 of Gian Singh v State of Punjab & Anr.2012 (9) SCALE 257, wherein the Apex Court has laid down the guidelines for exercise of powers under Section 482 Cr.P.C. while considering the prayer for quashing of proceedings.

At this stage, learned counsel for the Petitioner submits that in view of the decision of Apex Court in Gian Singh's case (Supra), he may be permitted to withdraw the present petition.
