O R D E R

% 17.03.2017 The status report tendered in court is taken on record. The petitioner has preferred the present petition to seek parole on the ground that he wishes to reconnect his social ties and look after his old aged parents. The petitioner is undergoing a 10 year sentence having been convicted in case FIR 115/2011 under Section 20 of NDPS Act. As per the nominal roll, he has already undergone 5 years 2 months 12 days incarceration as on 16.11.2016. The nominal roll shows that he has been convicted in two other cases arising out of FIR 134/2002 and 355/2001. While in the first case he has completed the sentence, in the second case he is on bail. The status report discloses the

involvement of the petitioner in 13 cases in all. He is also a bad character of the area.

Considering the fact that the petitioner has continuously remained incarcerated from 25.08.2011 for a period of over 5 years and his jail conduct has been found to be satisfactory for the last 4 years, the petitioner is directed to be released on parole.

In these circumstances, the petitioner is directed to be released on parole for a period of two weeks subject to:

i) his furnishing personal bond with one surety in the sum of Rs.25,000/- to the satisfaction of the Jail Superintendent; ii) he shall provide his mobile phone number to the Jail Superintendent at the time of his release, which shall be kept in working condition at all times. The same shall not be changed without prior intimation to the Jail Superintendent;

iii) he shall report at the local police station to mark his attendance on every alternate day at 11:00 a.m. during the period of parole; iv) he shall duly surrender at the end of the period of parole; and v) he shall also not indulge in any criminal activity while on parole.
