O R D E R

% 11.09.2018 CRL MA 8082/2018 (for modification of orders dated 08.02.2017 & 17.04.2017) By this application petitioner seek modification of orders dated 8th February, 2017 and 17th April, 2017 as the petitioner is unable to furnish surety bond as ordered by the said order, till date. Petitioner was granted parole for a period of four weeks by this Court vide order dated 8th February, 2017 directing the petitioner to furnish personal bond in the sum of `10,000 with one local surety of the like amount to the satisfaction of the Jail Superintendent besides imposing other conditions. As there was none in the family of the petitioner to furnish the surety, petitioner filed an application being Crl MA 8042/2017 seeking modification of the order dated 8th February, 2017 which was disposed of by this Court directing release of the W.P.(CRL) 3556/2016 P-1/2

petitioner on parole in terms of order dated 8th February, 2017 without insisting upon furnishing of the local surety. However, the petitioner still could not furnish surety bond. Hence, the present application. Petitioner has placed before this Court an earlier order passed by this Court in WP (Crl.) 742/2015 in favour of the petitioner wherein the petitioner was directed to be released on parole on furnish a cash surety. As noted above, despite benefit of parole being granted to the petitioner since 8th February, 2017, since there is none to furnish the surety bond, petitioner has not been able to avail of the same.

In view of the order dated 7th August, 2015 in Crl MA 11379/2015 in WP (Crl.) No.742/2015, order dated 8th February, 2017 is further modified. Petitioner is now directed to be released on parole for a period of four weeks on his furnishing personal bond in the sum of ₹10,000/- with one cash surety of the like amount, to the satisfaction of the Jail Superintendent. Other conditions as imposed vide order dated 8th February, 2017 will remain same. Application is disposed of.
