O R D E R
% 11.07.2017 Crl.M.A.10669/2017 (Modification of order dated 17.05.2017) The petitioner seeks modification of the order dated 17.05.2017 passed by this Court whereby he was directed to be released on furlough for a period of three weeks. One of the conditions put in the order was that the petitioner shall be released on furlough on his furnishing bond in the sum of Rs.10,000/- with two sureties of like amount, one out of them to be the sister of the petitioner, to the satisfaction of the Superintendent of the concerned jail.
Learned counsel for the petitioner submits that because of the straightened financial circumstances of the petitioner and his long incarceration, he is not able to arrange for two sureties. He, therefore, requests that the order be modified to the extent that he be released on furlough on his furnishing a bond in the sum of Rs.10,000/- with one surety only, who would be his sister, to the satisfaction of the Superintendent of the
concerned jail.
Taking into account the reasons assigned in the application seeking modification of the order, the prayer is allowed. The order dated 17.05.2017 is modified to the extent that the petitioner would be released on furlough for a period of three weeks, to be counted from the date of his release, on his furnishing a bond in the sum of Rs.10,000/- with one surety of the like amount, to be his sister, to the satisfaction of the Superintendent of the concerned jail. Other conditions imposed by the order dated 17.05.2017 shall subsist. The application is allowed and disposed of.
The order be communicated to the Superintendent of the concerned jail for compliance and record.
