O R D E R

% 19.07.2017 Learned counsel for the defendants on instruction of Mr. Arun Sharma, Managing Director of defendant no. 2 states that the defendants shall not use the trademark JINDAL or any other similar or deceptively similar mark in future. She clarifies that the goods of the defendants are being sold in the name of "VPPL of Varun Group, SS Pipes & Tubes". She also assures this Court that defendants shall not write either on the packaging material or on the product that the same is manufactured/made from JINDAL raw material or the word/mark JINDAL. She further undertakes to destroy the infringing goods / material seized by the Local Commissioner in the presence of a representative of the plaintiff.

In view of the aforesaid statements, learned counsel for the plaintiff does not wish to press the relief for damages and costs. The statements and undertakings given by both learned counsel for the parties are accepted by this Court and the parties are held bound by the same.

Present suit is decreed in accordance with the statements, undertakings and assurances given by learned counsel for the defendants and all pending applications stand disposed of. The Registry is directed to prepare a decree sheet.
