O R D E R

% 09.05.2017 (1) Present petition under Section 482 Cr.P.C. has been preferred by the petitioner for quashing of FIR No.273/15 under Sections 279/337 IPC registered at Police Station Hazarat Nizammudin. It is stated that the matter has been settled with the complainant/victims amicably. They have informed that the matter has been settled. (2) Learned counsel for the petitioner has placed on record copy of the order dated 26.04.2017 whereby the offence under Section 338 IPC has already been compounded.

(3) Since the parties have settled their disputes amicably before Mediation Centre, Saket Courts, New Delhi vide settlement dated 26.11.2016 (Annexure-C, Page 34) and the main offence under Section 338 IPC has already been compounded by the victims before CRL.M.C. 4820/2016

the Trial Court, no useful purpose will be served to continue with the proceedings under Section 279 IPC.

The victims have been compensated and `12,000/- have already been given to them. (4) Since the Respondent Nos.2 and 3 have voluntarily settled the dispute with the petitioner, no useful purpose will be served to continue with the proceedings. Taking into consideration the facts and circumstances of the case, in the interest of justice and to put an end to the litigation, FIR No.273/15 under Sections 279 IPC registered at Police Station Hazarat Nizammudin and all the proceedings emanating therefrom are quashed.

(5) The petitioner is, however, burdened with costs of `5,000/- to be deposited with Delhi High Court Legal Services Committee within two weeks. The Registry shall ensure the compliance of the order. (6) The petition is disposed of accordingly.
