% 22.12.2016 Mr. C.M. Goyal, Adv. has filed the counter-affidavit today in the Court. The same is taken on record. A copy thereof has also been given to Mr. Sanjay Sharawat. Mr. Goyal has pointed out to page 5 of the counter-affidavit and would also state that the case of the petitioner for affiliation was considered in the meeting held on 15th December, 2016 and the affiliation has been granted to the petitioner for the next academic session. The said statement is taken on record.

Insofar as the prayer (b) is concerned, the same cannot be allowed in view of the judgment of this Court in the case Samrat Ashok Private ITI vs. Directorate General of Training (DGT) W.P.(C) No. 9444/2016 and Kalam Private ITI & Ors. v. Directorate General of Training (DGT) W.P.(C) No. 9711/2016 dated December 06, 2016.

In view of the above, Mr. Sanjay Sharawat seeks to withdraw the petition. The writ petition and the accompanying application is dismissed as withdrawn.
