O R D E R
% 07.12.2016 Issue notice. Notice is accepted on behalf of the State. The petitioner seeks anticipatory bail under Section 438 Cr PC in case FIR 486/2016 dated 19.11.2016 registered at PS Badarpur. The allegation against the petitioner is that the petitioner entered into the house of the prosecutrix and molested her and that she was rescued by her father who arrived. According to the petitioner, the petitioner and the prosecutrix were friends and it is the prosecutrix who had called the petitioner to her home by making a call and sending a message on phone.
Learned counsel for the petitioner submits that the petitioner is ready and willing to join the investigation. He states that he shall provide the
mobile phone to the I.O. so that the same may be got examined forensically. In these circumstances, the application is allowed. In case of his arrest, the petitioner shall be released on bail upon his furnishing a personal bond with one surety in the sum of Rs.10,000/- to the satisfaction of the arresting officer. This is further subject to the condition that the petitioner shall join the investigation and provide the mobile phone and such other materials as may be possessed of in relation to the case to the I.O. He shall not contact the prosecutrix or any other witnesses or tamper with the evidence.
The application stands disposed of.
