Usha will file appropriate independent proceedings to claim her rights in the suit property on the ground that the impugned judgment and decree dated 29.9.2015 has been passed without her being a party to the decree or to the settlement arrived at before the mediation on 15.9.2015. 3.

Appeal is accordingly disposed of and this Court does not

observe one way or the other either prima facie or finally with respect to the rights of Smt. Usha.
