% 03.10.2018 Though the petition at hand was filed questioning the release on bail of the second respondent by order dated 29.08.2018 on bail application no.29073/2018, the counsel for the petitioner submitted that he does not press the petition on merits, his prayer for cancellation of bail under Section 439(2) Cr. PC being restricted to the fact that after the grant of the bail by the impugned order, there have been threatening calls made to the petitioner by or at the instance of the second respondent.
The Additional Public Prosecutor on instructions from W/SI Saroj Singh submitted that no allegations of threats having been extended, have been made in any report either to the police or to the court of the Magistrate or the court of Sessions till date by the petitioner.

The counsel for the petitioner, at this stage, submitted that he is under instructions to withdraw the captioned petition and the application filed therewith, the petitioner reserving the right to approach the court of Sessions under Section 439(2) Cr. PC on the basis of threats received after the grant of bail. The petition and the application filed therewith are dismissed as withdrawn.
