W.P.(C) 11609/2016 This writ petition is directed against an order of transfer, whereby, the petitioner has been transferred from New Delhi to Srinagar, Jammu and Kashmir. From the medical reports annexed to the petition, it appears that the petitioner's minor daughter Ms. Bharti Bhati, aged about 17 years suffered a head injury by reason of a fall. She appears to have undergone W.P.(C) 11609/2016

treatment at MAX Health Care, where she was even admitted to ICU. However, from the discharge summary annexed to the writ petition, it appears that all necessary procedures have been performed and the petitioner has now been discharged from the hospital. However, some follow-up treatment may be required. There can be no dispute that the job of the petitioner is transferable. Transfer is an incident of service. However, considering the special circumstances, the petitioner may be allowed six weeks' time to join the post to which the petitioner has been transferred. The writ petition is disposed of with the aforesaid directions. Dasti.
