% 20.12.2016 Petitioner claims to the legal heir of one Sh.Bhola Dutt Pandy who was squatting in front of Shop No.98, Babu Market, Sarojini Nagar. As per the petition, petitioner's father died in February, 2016. As petitioner was not permitted to vend, he filed Writ Petition (C) 5028/2016 which was disposed of on 25th July, 2016.

It is pointed out by learned counsel for the respondents No.1 and 2 that the reliefs claimed in the present writ petition are identical to the reliefs claimed and declined by order dated 25th July, 2016 and thus, the present petition is a gross abuse of process of the Court

and should be dismissed with exemplary costs. Learned counsel for the petitioner at this stage wishes to withdraw this petition and all applications. He submits that he would seek an appropriate remedy as available to him in accordance with law. The present petition is dismissed as withdrawn. G.S.SISTANI, J.
