After arguments and at the stage of dictation of the judgment, the appeal is not pressed but liberty is sought and which is granted that the appellant/plaintiff in the contempt petition which is pending would be entitled to damages on account of the stated violation by the contemnors of the interim order passed by the trial court. Without in any manner making observation one way of the other it is stated that nothing contained in the impugned judgment dated 3.9.2016 will in any manner prevent the trial court from deciding the petition for contempt filed by the appellant/plaintiff.

Accordingly, this appeal is disposed of as not pressed with liberty to the appellant to pursue the contempt petition filed and which will be disposed of by the trial court in accordance with law. VALMIKI J. MEHTA, J JULY 17, 2018/AK
