O R D E R

% 06.07.2018 The counsel for the petitioner submits that by subsequent order dated 17.11.2017, the sanction for prosecution against the public servants, who were also involved in the case has been found to be vitiated by the Special Judge and in the wake of such finding the case has since been transferred to the court of the Metropolitan Magistrate for further proceedings on the basis of the available material respecting offences, if any under the general law, the jurisdiction of the Special Judge under the Prevention of Corruption Act having come to an end. In this view, the counsel for the petitioner submits that he may be permitted to withdraw the present petition with liberty to agitate the contentions raised here at appropriate stage of the proceedings in the matter, which is now pending before the Metropolitan Magistrate.

The petition and the application filed therewith are dismissed as withdrawn with liberty as prayed granted.
