There appears to be a dispute with respect to whether the Show Cause Notice was duly served upon the petitioner. There does not seem to be clear evidence on record to conclude that the same was duly and timely served upon the petitioner.

Without further dwelling upon the aforesaid controversy, the Court finds it appropriate to set aside the impugned order dated 26.05.2017 qua the petitioner and the petitioner-institution is granted liberty to make a fresh representation. If the petitioner does so, let the same be dealt in accordance with law by the respondents.

With aforesaid observations, the petition stands disposed of alongwith pending application.
