The petitioner has filed this application seeking permission to withdraw the Bail Application No.2540/2016 with liberty to move a fresh bail application in the appropriate forum in the light of the new found facts, as and when required.

On 4th July 2017, the following order was passed by this Court:- "BAIL APPLN. 2540/2016

1. The petitioner has sought regular bail in case FIR No. 1213/2015 registered under Sections 363/376D/34 IPC and Section 6 of POCSO Act at PS Saket.

The application for release on regular bail was filed in December, 2016. During the pendency of the bail application, the petitioner filed another application being BAIL APPLN. 2540/2016

Crl.M.A.No.6599/2017 for release on interim bail which was granted to the petitioner for a period of four weeks. 3.

Learned counsel for the petitioner submits that after he was released on interim bail, his grandmother expired and during Court vacations in June, 2017 his father has also expired.

Learned counsel for the petitioner seeks permission to withdraw this bail application with liberty to apply for interim bail on the fresh ground i.e. death of his father. 5.

The petition is dismissed as withdrawn granting the liberty to apply for interim bail from the learned trial Court. 6.

The next date of hearing i.e. 24th August, 2017 stands cancelled.

CRL.M.B.1091/2017 Dismissed as infructuous."

As the Bail Application No.2540/2016 has already been dismissed as withdrawn on 4th July, 2017 and no bail application is pending as on date before this Court, the CM No.11346/2016 seeking permission to withdraw the Bail Application No.2540/2016 is dismissed. 4.
