O R D E R

% 09.12.2016 The grievance of the petitioner is two folds; firstly, after the demise of his mother who was squatting at Bangla Sahib Gurudwara, Ashoka Road, his name has not been substituted in the records of the NDMC. The second grievance is that his goods have been seized and the same are not being returned. The petitioner also prays that he should be allowed to squat at the place which was allotted to his mother.

We may notice that somewhat similar prayer was made by the petitioner in W.P. (C) No.10116/2016 which was disposed of as recently as on 26.10.2016 granting liberty to the petitioner to approach the Town Vending Committee ("TVC"). We are not satisfied with the grounds urged for filing of the second writ petition. However, as prayed, we direct the TVC to consider the application made by the petitioner for substitution in accordance with law expeditiously having regard to the fact that the petitioner claims that he suffers from a visual disability.

As far as release of goods is concerned, upon an application being made, the respondent will release the goods to the petitioner in accordance with law. As prayed, the petition is disposed of in above terms. Dasti.

C.M. No.45758/2016 (for stay) The application stands disposed of in view of the order passed in the writ petition.
