% 20.09.2018 Notice. Learned APP accepts notice for respondent no. 1. Respondent no.2-Smt. Komal is present in Court and has been identified by SI Ranbir Singh of police station Nangloi.
Respondent no.2 submits that she has settled the matter with her husband, that is, petitioner no.1 of her own free will and without any undue force, pressure or coercion vide Memorandum of Understanding dated 15.09.2016 and has started living with him since then. She further submits that in view of the settlement she has no objection in case FIR No. 143/2014 under Sections 498A/406/34 IPC registered at police station Nangloi and the consequent proceedings emanating therefrom are quashed against petitioner no. 1 and his relatives, that is, petitioner nos. 2 to 4.
Keeping in mind that husband (petitioner no.1) and wife (respondent no.2) have started living together after ironing out their differences, in my view, no fruitful purpose would be served to keep them entangled in criminal proceedings. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed. Petition is disposed of in the above terms. Miscellaneous applications are disposed of as infructuous.
