% 03.02.2017 CM 4486/2017 This application is listed today as item no. 19 through a supplementary list circulated in the forenoon today. Vide the said application, the petitioner seeks to withdraw the writ petition to file a fresh consolidated writ petition against the Directorate of Education, Govt. of NCT of Delhi as well as the Central Board of Secondary Education on the same cause of action. The prayers made are as under: "(i) Allow the petitioner to withdraw the writ petition with the liberty to file a fresh consolidated writ petition against both the Directorate of Education, Govt. of NCT of Delhi as well as the Central Board of Secondary Education on the same cause of action;

(ii) Pass any other or further order(s) that this Hon‟ble Court may deem fit in the facts and circumstances of the present case."

Noting the averments made in the application, the petitioner is permitted to withdraw the present petition with liberty as prayed for in accordance with law. The application is allowed.
