CORAM:

HON'BLE MR. JUSTICE G.S.SISTANI

O R D E R

% 21.10.2016 I.A.13065/2016 Succession Certificate was granted in favour of the petitioner by an order dated 11.05.2016. By the present application, the petitioner prays that both the administration bond and surety bond be dispensed with. Counsel submits that the matter was uncontested matter. The Succession Certificate has been granted in favour of the only son of the deceased Late Shri Krishan Prashad Gupta. The learned counsel relies upon the judgment in the case of Shakuntala Taxali v. State(Delhi Administration) and Others., reported at 61(1996) DLT 267. He also relies upon an order passed by this Court in the case of Sanjay Suri v. State, reported at 2003 (71) DRJ 446, wherein this Court had directed to dispense with the administration bond.

Accordingly, for the reasons given, the application is allowed. The condition of furnishing of administration bond and surety bond is dispensed with.
