The challenge in this writ petition is to an order of North Delhi Municipal Corporation ['NDMC'] dated 10.11.2016, by which the petitioner's request for permission to display advertisements by way of "wall wraps" on certain buildings situated on Barakhamba Road, New Delhi, was rejected.

During the pendency of the writ petition, the NDMC has issued a new policy, entitled Delhi Outdoor Advertising Policy, 2017 ["2017 policy"], which was formulated pursuant to the directions of the Supreme Court in M.C. Mehta vs. Union of India & Ors. [passed in Writ Petition(s) (Civil) No (s) 13029/1985]. By an order dated 03.08.2017, the Supreme Court also noted that there was no objection to the 2017 policy, annexed to a report of the Environment Pollution (Prevention and Control) Authority.

The petitioner has not applied for permission under the 2017 policy. In view of the regulatory amendment in terms of the 2017 policy, the writ petition is disposed of with the direction that the petitioner may apply afresh, under the 2017 policy which, will be considered by the NDMC in accordance with law, in terms of the current policy. The rights and contentions of the parties are left open and the petitioner will also be free to exercise its legal remedies afresh, in the event necessary.
