% 03.05.2017 (1) The petitioner seeks anticipatory bail under Section 438 Cr.P.C. in case FIR No.352/16 under Sections 498A/406/34 IPC registered at Police Station Dwarka. Section 313 IPC was added subsequently. Status report is on record.

(2) I have heard the learned counsel for the parties and have examined the file. By an order dated 09.12.2016, the petitioner was granted interim protection and was directed to join the investigation as and when required. Undisputedly, the petitioner has since joined the BAIL APPLN. 2534/2016

investigation. Marriage between the complainant and the petitioner took place on 21.11.2013. Comprehensive complaint implicating the petitioner and others was lodged on 16.11.2016. All sorts of allegations have been levelled in the complaint against the petitioner and his family members.

It is alleged that the petitioner is having an illicit relation with 'X' (assumed name) and is facing trial in Case FIR No.654/16 registered under Sections 354D/323/506/354/354B/ 328/354C/452/384 IPC at Police Station Mehrauli. He has been granted anticipatory bail by this Court on 29.7.2016. Parties are living separate since 2.8.2016. Nothing has come on record to show if any complaint was ever lodged earlier by the complainant who is posted as sub-inspector in Delhi Police for physical torture. (3) Considering the facts and circumstances of the case, the petitioner is admitted to anticipatory bail and in the event of his arrest, he be released on bail on his furnishing personal bond in the sum of `40,000/-with one surety in the like amount to the satisfaction of the SHO/Investigating Officer with the condition that he shall join the investigation as and when required.

(4) The bail application and all pending application(s) stands disposed of.
