% 23.10.2017 Petitioner is aggrieved by the letter of rejection dated 16.12.2014 vide which his application seeking allotment of an alternate plot had been declined for the reason that the application of the petitioner was time barred. This letter of rejection has been perused. It has communicated to the petitioner that he had received compensation of his acquired land on 01.8.2002. The petitioner was required to submit his application within the prescribed limitation of one year i.e. up to 31.7.2003 but he had submitted his application 29.9.2003. There was a delay of 59 days.

In Rattan Singh vs. Union of India & Ors. W.P.(C) 1967/1987 on the question of delay a Bench of this Court was of the view that if the petitioner is otherwise entitled to the allotment of an alternative

plot of land, then merely on the ground of any alleged delay on his part he should not be deprived of his right.

Accordingly, the delay of 59 days is condoned. The case of the petitioner be considered on merits. The representation of the petitioner will be answered seniority wise.

Petition disposed of.
