% 31.01.2018 The learned senior counsel appearing with Mr. Mohit Sharma and Mr. Rakesh Dudeja, advocates regret the default on the part of the counsel engaged by the appellant as noticed in the previous proceedings. It is explained that Mr. Mohit Sharma, advocate (also present) stands selected for appointment to Madhya Pradesh Higher Judicial Service, the result having been announced in October 2017. It is stated that thereafter Mr. Mohit Sharma, advocate has been busy returning the briefs or assisting the clients who had engaged him in engaging another advocate. The counsel nonetheless regrets that he did not inform this court or seek discharge from his responsibility. MAC.APP. 1114/2016

In the given facts and circumstances, as explained by the learned senior counsel, the costs imposed by the previous orders are waived. It is hoped that the counsel would hereinafter conduct themselves properly.

The learned senior counsel at this stage, on instructions, through the briefing counsel of the appellant, who is also present in person submits that the appeal and the applications filed therewith are not pressed and therefore may be allowed to be withdrawn. The appeal and the pending applications are dismissed as withdrawn. The interim orders are vacated.
