Petitioner impugns order dated 23.08.2018 whereby application under Order 6 Rule 17 CPC seeking amendment of the plaint filed by the respondent has been allowed.

Learned counsel for the respondent submits that the respondent seeks to unconditionally withdraw the suit filed before the trial court. Learned counsel for the respondent submits that the respondent has C.R.P. 201/2018

also initiated other proceedings apart from the suit against the petitioner and the withdrawal is without prejudice to the said proceedings.

In view of the above, the suit bearing No. 11615/2016 "Spiritual Regeneration Movement Foundation of India Vs. Pt. L.N. Sharma 85 Ors" pending in the Court of Ld. ADJ-04, South East District, Saket Court, New Delhi is dismissed as withdrawn. 4.

In view of the above withdrawal of the suit, learned counsel for the petitioner seeks leave to withdraw the present petition. 5.

The petition is accordingly dismissed as withdrawn. 6.

Copy of the order be forwarded to the learned trial court for necessary compliance.

Next date of 27.03.2020 is hereby cancelled.
