% 25.02.2019 The petitioner is aggrieved by alleged unauthorized construction in property bearing No. 122 Tarun Enclave, Pitampura, Delhi. The record shows that the petitioner has made complaints against the subject property by various complaint letters from 2017 onwards, but to no avail. The record also shows that a complaint dated 03.04.2018 was also made by the petitioner before the Monitoring Committee appointed by the Supreme Court in relation to the subject property.

Learned Standing Counsel for respondents Nos. 1 and 2/North DMC appears on advance copy and points-out that other things apart, initially the petitioner had filed complaints against unauthorized construction in several other properties, but is now choosing to confine his complaint only to the

subject property. He further states that the petitioner is not a resident in or around the area where the subject property is situate. Counsel says such conduct on the petitioner's part does not appear bona-fidé. 3.

After some submissions, learned counsel for the petitioner wishes to withdraw the present petition, with liberty to pursue the complaint before the Monitoring Committee and/or the Supreme Court. 4.

Accordingly, the present petition is dismissed as withdrawn, with liberty as prayed for.
