On 26.07.2024, the learned counsel for the respondents had informed the Court that the petitioner no.4 has superannuated from service as an Assistant Commandant while the rest of the petitioners had already been promoted under the Cadre Review. He had stated that in view of the subsequent developments, nothing survives in the present petition.

Today , the learned counsel for the petitioners confirms the above fact, however, submits that the question raised in the present petition would still survive as the challenge is to a Cadre Review. He, however, fairly also submits that the respondents have initiated a fresh exercise of Cadre Review.

The submission of the petitioners, that a fresh exercise for Cadre Review has been initiated by the respondents, is affirmed by the learned counsel for the respondents, on instructions. 4.

In view of the above subsequent developments, the present petition is disposed of making it clear that the persons similarly situated as the petitioners may file their representations before the competent authority in the fresh Cadre Review exercise that has been initiated and the disposal of this writ petition shall not be a bar or influence the Cadre Review Committee in considering such representations on merit.
