Mr. Mukesh Gupta, learned Standing Counsel for North Delhi Municipal Corporation has handed over an Status Report / Action Taken Report which is in continuation of the earlier action taken report filed by him. Let the same be taken on record. The report suggests that the complaint of the petitioner regarding the unauthorized constructions in the specified immovable properties have been addressed.

This writ petition discloses an extremely painful situation that only once writ petitions are filed pointing out unauthorized constructions, the respondents proceed to take action. In fact the officials sleep over these construction activities and it is impossible to believe that the officials did not
come to know about the illegal constructions which when commenced, required huge amounts of building materials.

This means that writ petitions are needed to be filed before the officials of the corporation proceed to act in respect of unauthorized constructions, which is an unfortunate and sorry state of affairs. As a result huge amounts from the public exchequer are required to be spent in the demolition action with tremendous amount of manpower, not only of the municipal corporations but also demolition squad and the officials who are requisitioned by the corporations for such completely unnecessary action which could be nipped in the bud, if the officials of municipal corporation did their duty at all. In addition precious judicial time is unnecessarily expended in compelling performance of statutory functions. 4.
This writ petition is disposed of in the above terms. 5.
Let a copy of this order be sent by the Registry to all three municipal corporations through their commissioners.
