% 20.02.2017 This Court had, in the presence of counsel for the petitioner, counsel for the NDMC as also Mr. Sumit, Mr. Tripathi, Advocates, visited the proposed site at Laxmi Bai Nagar, New Delhi. The site comprises of approximately 50-60 tharas which are viable for street vending. We may note that a covering in the form of asbestos sheets has also been provided. Besides, there is a public convenience booth as well. Prima facie, the learned counsel for the petitioner and other Advocates dealing with matters of street vendors including Mr.Tripathi and Mr.Sunit who had reached this site were satisfied with the proposed area to accommodate the street vendors. The Chairman, NDMC and Raj Shekhar, Director (Law) and Director (Enforcement) were also present. They submitted that in fact, this area can further be developed and public conveniences would also be provided, including drinking water facility, which would help the street vendors to carry out their business in dignity and the basic amenities would also be provided to both the visitors as also to the street
vendors. It was also brought to the notice of this Court that if this site is developed, this will go a long way to fulfil the aims and objectives of the street vendors under the Street Vendors (Protection of Livelihood and Regulation of Street Vending)Act, 2014. The only issue which would arise for consideration before the NDMC is the manner in which the allotment can be made in a fair and just manner.
