% 10.08.2017 This is a petition under Section 482 Cr.P.C. filed on behalf of the petitioner for setting aside/quashing the orders dated 31.05.2017 passed by the Court of Chief Metropolitan Magistrate, Saket Courts, New Delhi in RC No.10(E)/2002/EOW-1/DLI.
Status report has been filed by the respondent/CBI today in Court. Copy thereof has already been supplied to the learned counsel for the petitioner.
Learned counsel for the petitioner has submitted that the petitioner may be given one more opportunity to cross-examine the witness i.e. PW-23 Alok Mittal, who is the Investigating Officer of the case on the next date of hearing before the Trial Court.
Learned SPP for the respondent/CBI submits that the next date of hearing fixed before the Trial Court is 15th September, 2017 and he has no
objection if the petitioner is allowed to cross-examine PW-23 Alok Mittal, who is the Investigating Officer of the case, on the next date of hearing before the Trial Court.
In view of the submissions made by learned counsel for the parties, the prayer is allowed with the direction to the Court below to conduct the cross-examination of the aforesaid witness i.e. PW-23 Alok Mittal on the next date of hearing.
The present petition is allowed and stands disposed of accordingly. Copy of this order be given dasti to the parties, as prayed. I.S.MEHTA, J AUGUST 10, 2017 'dc'
