O R D E R

% 02.11.2017 Learned senior counsel for the petitioner submits that petitioner and complainant were directors in M/s Rudra Buildwell Space Pvt. Ltd. M/s Balaji Space Ventures Pvt. Ltd. is primarily owned by petitioner and his relatives. As regards M/s HR Infracity Pvt. Ltd. is concerned, complainant was the director in the said company. Petitioner and complainant were doing some business together and some independently.

Disputes arose between them.

Petitioner filed a civil suit being CS (OS) 856/2014 for recovery of `12 crores against the respondent (complainant) wherein, vide order dated 25th March, 2014, complainant and other defendants of his group were directed to furnish a bond in the sum of `12 crores in favour of the plaintiff (petitioner). M/s Balaji Space Ventures Pvt. Ltd. also filed a suit CS(OS) 594/2014 for recovery of over `19 crores against M/s HR Infracity Pvt. Ltd. and others. It is submitted that as a

counter blast complainant lodged present FIR alleging therein that petitioner had illegally withheld three cars of M/s Rudra Buildwell Home Pvt. Ltd., M/s Rudra Buildwell Projects Pvt. Ltd. and M/s Rudra Buildwell Space Pvt. Ltd. Learned APP submits that all the three cars have already been seized in September, 2017. He further submits that investigation is almost complete and charge-sheet is likely to the filed within a month. It is further submitted that petitioner has already joined the investigation. Keeping in mind totality of the circumstances, it is ordered that in case of arrest petitioner be released on bail, subject to his furnishing a personal bond in the sum of `50,000/- with one surety in the like amount to the satisfaction of the Investigating Officer/Arresting Officer/SHO of the concerned police station.

Bail application is disposed of in the above terms. Dasti.
