CRL.M.C. 2731/2017 & CRL.M.As. 11285/2017 & 31791/2018 Revision petition filed by respondent No. 2 is pending before the Revisional Court. Vide order of 1st June, 2017, Revisional Court had listed this revision petition for hearing on 19th July, 2017. Impugned order is purely interlocutory.
Learned counsel for petitioner points out that in the impugned order, it is noted that pending investigation in a cheating case has got no relevance with regard to revision petition, which is against cancellation of Page | 1
the murder case by the police. It is submitted that revision petition essentially relates to a Will of 24th February, 2007 and the authenticity of the said Will is required to be gone into.
Aforesaid aspect is not required to be gone into by this court. The revisional court while hearing revision petition shall take this aspect into consideration.
This petition and the applications are accordingly disposed of with liberty to petitioner to urge the pleas taken herein before the revisional court.
