% 13.02.2019 Learned counsel for the respondents tendered in Court a copy of the judgment passed by the Supreme Court in Orissa Lift Irrigation Corporation Limited vs. Rabi Shankar Patro & Ors., (2018) 1 SCC 468. In the said decision, the Supreme Court has held that All India Council for Technical Education (AICTE) constituted under All India Council for Technical Education Act is the sole repository of power to lay down parameters or qualitative norms for "technical education". Supreme Court has held that theory and practical constitute integral part of technical education and AICTE has not laid down that practical could be conducted through distance education mode. Thus, imparting of engineering courses could not have been permitted by the Distance Education Council (DEC). Ms. Mainee, ld. Counsel for the petitioners does not dispute the fact

that the said decision of the Supreme Court covers the case of the present petitioners, since the petitioners are claiming their rights on the basis of technical degree obtained by them through distance education. Accordingly, the petition is dismissed.
