% 09.12.2016 CRL.M.A.19259/2016 Exemption granted, subject to all just exceptions. Application stands disposed of.

CRL.M.C. 4612/2016 Counsel for the petitioner has submitted that the counsel who appeared for the petitioner in the Court below noted down wrong date inadvertently and therefore, petitioner could not appear in the Court below, hence, NBWs were issued against the petitioner on 29th November, 2016.Counsel for the petitioner has further submitted that the petitioner wants to appear before the Court below and prays that the petitioner be released on bail.

Learned APP for State has vehemently opposed the contention of

learned counsel for the petitioner and submitted that by conduct the petitioner is negligent and the Court below has rightly passed the order. Looking into the above facts, the petitioner is directed to appear before the Court below on 28th January, 2017 and in the event of his arrest, he be released on bail on his furnishing a bail bond in the sum of Rs.50,000/- with one surety of the like amount to the satisfaction of the concerned Court below till 28th January, 2017. The petitioner is directed to move appropriate application before the Court below who shall consider the same and proceed with the matter in accordance with law.

The present petition is disposed of accordingly. All pending application(s) (if any) also stand disposed of. Copy of the order be given dasti as prayed.
