This is an application moved by the petitioner under SEction 438 Cr.P.C. seeking anticipatory bail in case FIR No.44/2017 under Sections 417/447/468/471 IPC, PS IGI Airport.

Learned counsel for the petitioner submits that since the petitioner has approached this Court directly for seeking anticipatory bail under the impression that there is concurrent jurisdiction, he may be permitted to withdraw the instant application with liberty to approach the Court of Sessions for seeking anticipatory bail and depending upon the fate the bail application to be filed before the Court of Sessions to approach this Court if the necessity arises.

Accordingly, the bail application is dismissed as withdrawn granting the liberty as prayed.
