O R D E R
% 20.11.2018 The counsel for the petitioner has submitted and the counsel for the second respondent confirms that in terms of the directions in the order dated 02.08.2018, the petitioner has since paid to the second respondent who has received from the former, a total amount of Rs.10 Lakhs "on account", to be adjusted against the final decision to be rendered on the two cross-appeals pending in the court of the Sessions.
The counsel for the petitioner also submits that he is continuing to pay Rs.50,000/- p.m. to the second respondent in terms of the
anticipatory bail order and undertakes to continue paying the said amount till such order remains operative.
After some haring, it has been agreed by both sides, that instead of the issue of compliance or non-compliance with the existing order of interim maintenance being gone into, a request be made to the first appellate court (the court of Sessions presided over by Mr. Sanjeev Kumar, Additional Sessions Judge) to hear the parties and adjudicate on their respective appeals against the order of the Metropolitan Magistrate at an early date. Thus, the concerned court of the Sessions is requested to take up the appeals (Cr. Appeal Nos.204262/2016 and 204347/2016, both filed by the petitioner and Cr.
Appeal No.204192/2016 filed by the respondent) which are stated to be listed on 29.11.2018 for hearing on the said date or on any early convenient date thereafter and adjudicate upon the same at the earliest preferably within two months of the said date.
The counsel on both sides have assured that they would go ready with their respective written submissions running into not more than four sheets, supported by case law duly highlighted and referenced and present the same before the said appellate court, seeking to address orally not more than for 15 minutes each. Ordered accordingly.
Further enforcement of the order of interim maintenance granted by the Magistrate court shall remain suspended till the decision on the appeals is taken by the court of Sessions. No further directions are required in the matter at hand which
stands disposed of.
