% 30.01.2019 The counsel for the petitioner submits that on account of some mis-communication with the previous counsel, there was default in appearance on 23.07.2018 leading to the costs being imposed. On this explanation orally tendered, the request for waiver of costs imposed on 23.07.2018 is granted.

After some hearing, the learned counsel for the petitioner, on instructions, submits that he may be permitted to withdraw the captioned petition, the petitioner reserving the contentions set out in the petition as defence to be raised before the trial court. The petition is dismissed as withdrawn.
