% 09.12.2016 Though the writ petition has been filed for various reliefs, Mr.R.K.Saini, learned counsel for the petitioner states that he would be satisfied if the present writ petition is treated as a representation qua prayers (c) and (d) alone to DDA and the same is directed to be disposed of in a strict time frame.
Issue notice.
Mr.Dhanesh Relan, learned standing counsel accepts notice on behalf of the respondent-DDA. He states that the present writ petition is barred by delay and laches.
However, this Court is of the opinion that as the petitioners have made a number of representations to the respondent-DDA which have not been disposed of till date, the respondent-DDA is directed to
dispose of the same.
Consequently, without prejudice to the rights and contentions of the parties, this Court directs that prayers (c) & (d) of the present writ petition be treated as a representation to the Commissioner (LD), DDA, who is directed to decide the same in accordance with law within a period of twelve weeks by way of a reasoned order. A copy of the order shall be communicated to the petitioners by registered AD post.
In view thereof, present writ petition is disposed of. It is clarified that pleas and defences of all the parties are left open.
