O R D E R

% 17.03.2017 The petitioner has preferred the present bail application to seek regular bail under Section 439 Cr.P.C. in case FIR No.98/2014 registered under Section 498A/ 304B/ 34 IPC at PS - Anand Parbat. The petitioner is in judicial custody since 09.03.2014. She is the mother-in-law of the deceased. The prosecution has already led its entire evidence. It is informed that the case is now coming up before the learned Trial Court on 15.04.2017 for recording the petitioner's statement under Section 313 Cr.P.C.

Considering the fact that the petitioner is a 58 years old lady and she has already remained in custody for over 3 years, as also the fact that the

prosecution has already led its entire evidence, in my view, no useful purpose would be served in keeping the petitioner in custody any further at this stage.

Accordingly, the petitioner is directed to be released on bail, subject to:

(i) her furnishing personal bond with one surety in the sum of Rs.20,000/- to the satisfaction of the Jail Superintendant; (ii) she shall provide his mobile number at the time of her release to the Trial Court, which shall be kept in working condition at all times and shall not be changed without prior intimation to the Court; and (iii) she shall not leave the country without prior permission of the Court.
