% 27.07.2018 Petitioner no.1 is a registered society. Petitioner no.2 is one of its members. This writ petition has been filed by the petitioners seeking the following reliefs:

a) To remove/demolish the unauthorised encroachment done by the shop keepers by extending wall towards govt. road and the removal of the vegetable vendors which are sitting without any authorities and permission on the road/street of Jagat Ram Mkt. / Park, L-Block, Laxmi Nagar, Delhi as shown in site plan attached; and b) Issue a writ of Mandamus directing the respondents to exercise their statutory power and perform their duties as per provisions of law and take appropriate actions in the matter and restore the road/street of Jagar Ram Mkt./Park, L-Block, Laxmi Nagar, Delhi to its original position as per records of the respondents.

Learned counsel for the petitioners submits that in view of the order dated 28.2.2017 passed by this Court, he does not wish to press the present petition although he submits that some of the encroachers have returned back to the area in question. Counsel further submits that in case the respondents fail to keep the area encroachment free, he seeks liberty to approach this court again. In view of the submissions made, present writ petition stands dismissed as not pressed. Liberty, as prayed for, is granted. G.S.SISTANI, J P.S. TEJI, J JULY 27, 2018 msr/
